DECREE OF THE MINISTER OF INDUSTRY AND TRADE
NO. 594/MPP/Kep/9/2004

CONCERNING
THE APPOINTMENT OF SURVEYORS AS TECHNICAL VERIFIERS OR INQUIRERS OF SUGAR IMPORT

THE MINISTER OF INDUSTRY AND TRADE,

Considering:

• a. that in the framework of executing Article 14 of Decree of the Minister of Industry and Trade No. 527/MPP/Kep/9/ 2004 on sugar import provisions, it is necessary to stipulate surveyors as technical verifiers or inquirers of sugar import;
• b. that in relation thereto, it is necessary to issue a decree of the Minister of Industry and Trade;

In view of:

Decree of the Minister of Industry and Trade No. 527/MPP/Kep/9/2004 on sugar import provisions;

DECIDES:

To stipulate :

FIRST:

To appoint surveyors:

• 1. PT (Persero) Sucofindo;
• 2. PT (Persero) Surveyor Indonesia.

As technical verifiers or inquirers of sugar import.

SECOND:

The two surveyors as meant in Dictum FIRST shall have the following tasks:

• 1. technically verifying or inquiring data or information about:
• a. country of origin of sugar;
• b. specifications of sugar, covering HS Number, ICUMSA Figure and description of sugar;
• c. quantity and kind of sugar;
• d. shipment period in the framework of adjusting to the validity period of import approval; and
• e. destination port.
• 2. mentioning results of the technical verification or inquiry as meant in point 1 into Surveyor Report used as import document;
• 3. conveying written report on technical verification or inquiry of sugar import periodically, every month, in the first week of the ensuing month to the Director General of Foreign Trade in this case the Director of Import, Ministry of Industry and Trade.

THIRD:

The lateness or other mistake in the issuance of Surveyor Report attributable to negligence of surveyors intentionally or unintentionally shall become the responsibility of surveyors, in accordance with the provisions in force in the International Federation of Inspection Agency (IFIA).

FOURTH:

In executing the technical verification or inquiry of sugar import, surveyors can collection compensation or fee of the rendered service from sugar importers with the amount adjusted to the principles of benefit.

FIFTH:

All costs related to the implementation of this decree shall be borne by surveyors.

SIXTH:

The appointment of surveyors as meant in Dictum FIRST shall not abolish the authority of the Minister of Industry and Trade to revoke, replace and supplement the appointment of surveyors as technical verifiers or inquiry of sugar import.

SEVENTH:

Technical provisions related to the implementation of this decree shall be stipulated by the Director General of Foreign Trade, Ministry of Industry and Trade.

EIGHTH:

The decree shall come into force as from the date of stipulation.
